Welcome to curbstomp.co (the "Website"). By accessing or using the Website and purchasing products from CURB STOMP, you agree to be bound by these Terms & Conditions ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing the Website, creating an account (if applicable), or purchasing products from CURB STOMP, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or purchase our products.  

2. Entire Agreement

These Terms constitute the entire agreement between you and CURB STOMP regarding your use of the Website and your purchases of products, and supersede all prior or contemporaneous communications and proposals, whether oral or written.

3. Website Use

This Website is intended for users who are interested in purchasing sporting goods and apparel. You are responsible for ensuring that your use of the Website complies with all applicable laws and regulations.

4. Product Information

We strive to provide accurate descriptions and images of our products. By using this Website, you acknowledge that CURB STOMP is its own distinct brand, and all product designs, graphics, and intellectual property associated with CURB STOMP are owned by CURB STOMP. You are strictly prohibited from copying, replicating, or otherwise using our product designs or intellectual property without our express written consent.  

5. Pricing and Payment

All prices displayed on the Website are in United States Dollars (USD). Payments are securely processed through the Wix platform. Sales tax is not included in the displayed prices and will be calculated and added to your order total where applicable. In the event of a pricing error on the Website, CURB STOMP reserves the right to correct the error and is responsible for honoring the correct price.

6. Ordering Process

Orders for CURB STOMP products can only be placed online through our official Website (curbstomp.co) or through authorized partner stores. For purchases made through partner stores, the partner store assumes full responsibility for the transaction, fulfillment, and customer service related to that purchase. CURB STOMP reserves the right to accept, reject, or cancel any order at our discretion.

7. Shipping and Delivery

Shipping for skateboard products is handled directly by our manufacturers, and shipping for MMA training gear and apparel is handled directly by CURB STOMP. Delivery times will vary depending on the manufacturer's processing and shipping times for skateboard products, and CURB STOMP's processing and shipping times for other items. You will be provided with estimated delivery information where available. CURB STOMP is not responsible for lost or damaged goods during shipping until an internal investigation determines that the loss or damage was directly caused by CURB STOMP's handling.

8. Returns, Exchanges, and Refunds

Returns and refunds are handled on a case-by-case basis. Please contact us at Curbstompskateco@gmail.com with your order details and the reason for your return request. We do not currently offer exchanges. Any refunds issued will be at the sole discretion of CURB STOMP.

9. User Content Agreement

If the Website allows you to submit, upload, post, email, or otherwise make available content, including but not limited to reviews, comments, photos, and videos ("User Content"), you grant CURB STOMP a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the User Content that you post; that the User Content is accurate; that use of the User Content you supply does not violate these Terms and will not cause injury to any person or entity; and that you will indemnify CURB STOMP for all claims resulting from User Content you supply. CURB STOMP has the right but not the obligation to monitor and edit or remove any User Content.  

10. Prohibited Actions

When using the Website, you agree not to:

  • Infringe upon the intellectual property rights of CURB STOMP or any third party.

  • Upload, post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

  • Interfere with or disrupt the operation of the Website or the servers or networks used to make the Website available.

  • Attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Website.

  • Engage in any data mining, robots, scraping, or similar data gathering or extraction methods.

  • Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.

  • Use the Website for any commercial solicitation purposes without the express written consent of CURB STOMP.

  • Attempt to copy, replicate, or create derivative works from the Website's design or code.

11. Indemnification

You agree to indemnify, defend, and hold harmless CURB STOMP, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Website, your User Content, or your breach of these Terms.  

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Website shall be brought exclusively in the state or federal courts located in New Jersey, and you hereby irrevocably consent to the personal jurisdiction of such courts.  

13. Limitation of Liability

To the fullest extent permitted by applicable law, CURB STOMP shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your access to or use of the Website, your purchase of products, or these Terms, even if CURB STOMP has been advised of the possibility of such damages. In no event shall CURB STOMP's total liability to you for all claims arising out of or relating to these Terms or your use of the Website exceed the total amount paid by you to CURB STOMP for the applicable products or services.  

14. Changes to Terms & Conditions

CURB STOMP reserves the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Website. We will notify registered users of any material changes to these Terms via email. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms.
